These Termsgovern the use of the ClearMark™ Certification Badges (“Badges”) by creatorswhose courses have been audited and certified by ClearMark B.V. (“ClearMark”). Byusing a Badge, you agree to the following:
1.License ClearMark grants you a non-exclusive, non-transferable, revocable license to use the Badge only for the course(s) that successfully passed a ClearMark audit. You may display the badge on your course website, sales page, and marketing materials exactly as provided by ClearMark. The badge may not be altered, animated, combined with other graphics, or used in a misleading manner.
2. Validity Badges are valid for 12 months from the audit date. After expiry, a re-audit is required for renewal. Badges must be removed immediately after expiry or revocation.
3. Scope & Disclaimer The Badge certifies that your course met ClearMark’s internal audit criteria at the time of review. The Badge does not constitute accreditation under any governmental, academic, or regulatory authority. ClearMark does not guarantee educational outcomes, business results, or student success.
4. Revocation ClearMark reserves the right to revoke a Badge in case of: Misuse of the Badge. Substantial changes to the certified course without re-audit. Evidence of false or misleading claims. Procedure: In case of misuse, ClearMark will notify you in writing. You will have 14 days to remedy the issue. If not corrected, the Badge will be revoked immediately. Revocation or failure to pass an audit does not entitle you to a refund or compensation.
5. Refund Policy All audit fees are non-refundable, regardless of the outcome. Revocation or expiry of a Badge does not create any right to repayment.
6. Liability ClearMark is not liable for: The content or quality of your course. Student outcomes or commercial results. Any claims brought by students, consumers, or third parties. By using the Badge, you indemnify ClearMark against any claims related to your course.
7. Intellectual Property The ClearMark™ name, logo, and badge designs are protected trademarks and copyrighted works. Unauthorized use, reproduction, or modification is strictly prohibited. ClearMark actively enforces its IP rights internationally.
8. Governing Law & Dispute Resolution These Terms are governed by the laws of the Netherlands. Any disputes that cannot be resolved amicably shall be submitted to binding arbitration under the ICC Rules, with the seat in Amsterdam, the Netherlands, and proceedings in English.
9. Updates ClearMark may update these Terms from time to time. The latest version will always be available at [clearmark-cc.com]. Continued use of the Badge constitutes acceptance of any updates.
