Terms of Service – ClearMark™

These Terms of Service (“Terms”) govern your use of theClearMark™ website, services, and certifications. By applying for an audit orusing our services, you agree to these Terms. Please read them carefully.

1. About ClearMark™
ClearMark™ is an independent certification body for onlinecourses. We provide audits across 12 trust domains and issue badges (Gold,Silver, Bronze) to courses that meet our standards.

2. Eligibility
You must be at least 18 years old to apply for a ClearMark™ audit. By     submitting a course for review, you confirm you are the rightful owner of     the course materials or have authorization to represent the owner.

3. Services provided

ClearMark™ audits are delivered within 48 hours (unless otherwise communicated).
You will receive:
A written audit report across 12 domains.  
A badge (Gold, Silver, or Bronze) only if standards are met.  Not all applicants will receive a badge.

4. Badge use & revocation
Badges may only be displayed on the specific course(s) that were audited and certified.
You may not transfer or reuse a badge for other products, pages, or courses. If substantial changes are made to a certified course (e.g. content, pricing, structure), the badge becomes provisionally invalid. A re-audit is required to maintain certification.
ClearMark™ reserves the right to revoke badges at any time if:
Misuse  or misrepresentation is detected.  
The certified course is altered in a way that no longer meets ClearMark™ standards.  
Fraud, plagiarism, or deceptive practices are identified.

5. Payments & refunds
Pricing for audits is listed transparently on our website. Payments are processed securely via Stripe.
All payments are non-refundable once the audit process has started.
Refunds are only issued if:
Payment was made in error.
The audit has not yet begun.

6. Confidentiality
All materials submitted for audit are treated as strictly confidential. Materials are used solely for your ClearMark™ audit and deleted within 30 days after delivery.
ClearMark™ staff and auditors operate under confidentiality agreements.

7. Intellectual property
You retain full ownership of your course content. By submitting content for audit, you grant ClearMark™ a limited license to review the materials solely for certification purposes. The     ClearMark™ name, logo, and badges are trademarks of ClearMark™ and may only be used as permitted under these Terms.

8. Limitation of liability
ClearMark™ provides audits and certifications on a best-effort basis. We do not guarantee specific commercial results (e.g. sales increase, enrollments). To the maximum extent permitted by law, ClearMark™ is not liable for indirect, incidental, or consequential damages arising from use of our services.

9. Data protection (GDPR)
ClearMark™ complies with the EU General Data Protection Regulation (GDPR). For details on how we collect and process data, please see our Privacy Policy.

10. Termination
You may stop using our services at any time. ClearMark™ may suspend or terminate services if you violate these Terms.

11. Governing law
These Terms are governed by Dutch law. Any disputes shall be handled by the competent court in The Hague, the Netherlands.
